Kalshi v. New York (Gaming Commission)

For the states PI denied; appeal in briefing

Judge Analisa Torres denied Kalshi a preliminary injunction on July 7, 2026, holding New York's gambling laws are not preempted as applied to its sports contracts (and dismissing the Commission itself on Eleventh Amendment grounds). The district court and a Second Circuit judge refused interim relief in late July, after which New York's enforcement standstill lapsed. The appeal will be heard in tandem with Kalshi's and Coinbase's Connecticut appeals; the CFTC filed an amicus brief for Kalshi.
