CFTC v. Kentucky

Pending Pending — argument postponed; supplemental briefing ordered

The CFTC sued after Kentucky filed state-court civil enforcement actions seeking penalties from CFTC-registered exchanges (reported as filed June 17, 2026 against Kalshi, Polymarket, Coinbase, Robinhood and Webull) and imposed a special transaction fee on those exchanges. The suits against Kalshi and Polymarket were removed to the same federal court. Correction: the Oct. 9, 2026 argument previously listed here did not go forward. By order dated Oct. 5, 2026, Judge S. Chad Meredith canceled it and directed simultaneous 15-page supplemental briefs, due Oct. 23, on the Sixth Circuit's Schuler decision and any effect of the forthcoming CFTC rulemaking, with the parties to propose at least three new argument dates.
